RETURN AND REFUND POLICY (EUROPEAN UNION / EEA)

At DaVinci we want you to be thrilled with your order, and we strongly recommend that you do your research prior to making a purchase. If you are not satisfied, this policy explains your statutory right of withdrawal as an EU consumer, how refunds work, and how to return an item. Nothing in this policy limits your rights under EU consumer law or the mandatory consumer protection laws of your country of residence. This policy applies to purchases made directly on this website (operated by Synergy Imports LLC, doing business as DaVinci Tech). Purchases made from retail stores or other online retailers are subject to the return policy of that retailer.

Your 14-Day Right of Withdrawal

As a consumer in the EU/EEA, you have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. If your order contains multiple items delivered separately, the period expires 14 days after the day you acquire physical possession of the last item.

To meet the withdrawal deadline, it is sufficient that you send us your notice of withdrawal before the 14-day period has expired. This right applies to all items purchased on this website, including sale and discounted items, subject only to the legal exceptions described in the Exceptions section below.

How to Exercise Your Right of Withdrawal

You can notify us of your decision to withdraw in any of the following ways:

Any unequivocal statement setting out your decision to withdraw from the contract is sufficient. Please include your order number and the item(s) you are returning so we can process your request quickly. If you notify us using the withdrawal function or electronically, we will send you an acknowledgement of receipt of your withdrawal without delay in a durable medium (such as email).

Once you notify us, we will email you return instructions, including the return address and a Return Authorization number. Using the Return Authorization number helps us identify and process your return quickly, and we ask that you write it on the outside of the return packaging. However, your statutory right of withdrawal is not conditional on obtaining or using a Return Authorization number.

Refunds

If you withdraw from your purchase, we will reimburse all payments received from you, including the costs of standard delivery to you, without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw. If you expressly chose a more expensive delivery method than our least expensive standard delivery, we will reimburse the cost of standard delivery only, and the supplementary delivery costs will not be reimbursed.

We will carry out the reimbursement using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold the reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earliest.

If a free item was included with your order as part of a promotion and you return the order or the qualifying item, please return the promotional item as well; if it is not returned, we may deduct its value from your refund.

Returning the Goods

You must send back the goods without undue delay and in any event no later than 14 days from the day on which you notified us of your withdrawal. The deadline is met if you send the goods back before the 14-day period has expired.

You will bear the direct cost of returning the goods. We recommend using a tracked shipping service and considering shipping insurance, as you are responsible for the goods until they reach us. Please pack the product securely, using the original packaging material where possible or bubble wrap or similar supplies, and include all accessories and component parts that came with the product.

Condition of Returned Goods and Diminished Value

You are entitled to inspect and handle the goods to establish their nature, characteristics and functioning, in the same way you would be able to in a physical shop. You do not lose your right of withdrawal by opening the box.

However, you are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (for example, using a device rather than merely inspecting it). Where the value of returned goods has been diminished by such handling, we may deduct an amount corresponding to the actual diminished value from your refund. Items returned new and unused in their original packaging will always receive a full refund.

Exceptions to the Right of Withdrawal

In accordance with EU law, the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery. For our products, this applies to items such as mouthpieces and other hygiene-sealed accessories that come into contact with the mouth, where the hygiene seal has been broken. If a hygiene-sealed component of a returned product has been unsealed, the withdrawal exception applies to that component only, and any deduction will reflect its value.

Damaged, Missing or Incorrect Items

If your package arrives with damaged, missing or incorrect items, please contact us as soon as possible, ideally within 72 hours of delivery, so that we can resolve the issue quickly and file any claim with the carrier while the evidence is fresh. Prompt reporting helps us help you, but it does not limit your statutory rights. Where an item is damaged in transit, missing or not what you ordered, we will arrange a replacement or a refund and we will bear the cost of any return shipping.

Separately from the right of withdrawal, you benefit from the legal guarantee of conformity under EU law and the law of your country of residence. If a product is defective or otherwise not in conformity with the contract, you are entitled to remedies, including repair or replacement and, where applicable, price reduction or termination of the contract, for a period of at least two years from delivery. Returns under the legal guarantee are free of charge to you. Any commercial warranty offered by DaVinci is in addition to, and does not affect, these legal rights. Exchanges

If you would like to exchange an item, contact us within 14 days of delivery via our Contact Form and we will be happy to help you arrange it. An exchange is offered as a courtesy in addition to, and never instead of, your statutory right of withdrawal: you may always choose a refund under the withdrawal process described above.

Notice

Processing times: once your return arrives at our facility, please allow up to 14 days for inspection and processing; in all cases, refunds for withdrawal are issued within the statutory 14-day period described in the Refunds section above. DaVinci may amend this policy from time to time by posting the amended terms on this page; amendments apply to orders placed after the date of posting and never affect your statutory rights.
